Welcome to Upper Echelon, operated by Delta Survival School s.a.r.l (referred to as "Upper Echelon," "we," "us," or "our"). By accessing and using our services, you agree to comply with the following terms and conditions.

1. Interpretation and Definitions
1.1 Interpretation: Words with an initial capital letter have specific meanings defined below. These definitions apply regardless of whether they appear in singular or plural form.

1.2 Definitions:

  • Company refers to Delta Survival School s.a.r.l, operating under the brand Upper Echelon.

  • Country refers to Luxembourg.

  • Feedback means feedback, suggestions, or innovations sent by you regarding our services.

  • Service refers to the website and all activities, events, and training offered by Upper Echelon.

  • Terms refer to these Terms and Conditions, which form the entire agreement between you and the Company regarding the use of the Service.

  • You refers to the individual or legal entity accessing or using the Service.

2. Acknowledgment
2.1 These Terms and Conditions govern the use of our services and form the agreement between You and Upper Echelon. By using our services, You agree to comply with these Terms.

2.2 If You disagree with any part of these Terms, please refrain from using our services.

3. Payment Terms
3.1 Payment Methods: We accept credit cards (Visa, MasterCard, American Express), PayPal, and bank transfers. All payments are due upon booking.

3.2 Deposits and Deadlines: A non-refundable deposit may be required to secure your booking for courses, workshops, and events. Full payment must be made by the specified deadline.

3.3 Late Payments: Failure to pay by the deadline may result in cancellation without refund.

4. Cancellation Policies
4.1 Workshops and Courses:

  • Cancellations must be submitted in writing via email to info@upechelon.com.

  • Cancellation Fees:

    • More than 30 days before start date: Full refund minus 10% administrative fee.

    • 15 to 30 days before start date: 50% refund.

    • Less than 15 days before start date: No refund.

  • Substitutions: Another participant may replace you without penalty if notified at least 5 days before the start date.

  • Cancellation by Upper Echelon: If we cancel, participants will receive a full refund or the option to transfer to another event.

4.2 Survival Expeditions:

  • Participant Cancellations:

    • More than 2 months before start date: Full refund minus €150 administrative fee.

    • 30 days or less: 50% refund.

    • 15 days or less: No refund.

  • Emergencies: Refunds for medical or accidental emergencies require documented proof (e.g., doctor’s note).

5. Health and Fitness Requirements
5.1 Participants must meet specific health and fitness requirements to join events. We may require medical clearance or fitness assessments to confirm eligibility.

5.2 You are responsible for consulting a physician to ensure you are fit to participate in training and activities.

6. Waivers and Liability
6.1 Assumption of Risk: You acknowledge the inherent risks of our activities and voluntarily assume responsibility for your participation.

6.2 Release of Liability: Upper Echelon is not liable for injuries, losses, or damages arising from participation.

6.3 Waivers: All participants must sign a liability waiver before attending. Failure to do so will result in cancellation without refund.

7. Data Protection and Privacy
7.1 Personal data is handled in accordance with our Privacy Policy and applicable data protection laws. We do not share data with third parties except as required to provide services.

8. Marketing and Media
8.1 Photos or videos taken during activities may be used for marketing purposes. Notify us in writing before the event if you wish to opt out.

9. Dispute Resolution
9.1 Disputes will first be resolved informally by contacting us.

9.2 If necessary, disputes will be resolved via mediation or arbitration in Luxembourg under Luxembourg law.

10. Force Majeure
10.1 Upper Echelon is not liable for cancellations due to events beyond our control, such as natural disasters or pandemics. Refunds or rescheduling are at our discretion.

11. General Provisions
11.1 Late Arrivals/Early Departures: No refunds or rescheduling for missed time.
11.2 Amendments: We may update these Terms, with changes applying to future enrollments.
